On April 16, 2025, Ministerial Resolution No. 199-2025-MTC/03 was published in the Official Gazette “El Peruano”, which approved the Call for the Special Mechanism for the Allocation and Conditioning of the 3.5 GHz frequency band for the provision of public telecommunications services through fifth generation (5G) or higher technology, and modified the National Frequency Allocation Plan (the “Resolution”).
The Resolution approves the call for the special mechanism for the assignment and conditioning of the 3.5 GHz band (“Special Mechanism”), within the framework of which operators may express their interest in obtaining assignments or conditioning their spectrum in such band, attaching the corresponding legal, technical and economic-financial requirements.
The Resolution also specifies the additional mandatory investment commitments to be executed by the operators as consideration for their participation in the Special Mechanism, among others.
Finally, the Resolution modifies Note P73 and eliminated Notes P73A and P73B of the National Frequency Allocation Plan. Among other changes, the existing reservation in the 3300 – 3800 MHz band was lifted.
