SBS REGULATIONS
Superintendency of Banking, Insurance, and Private Pension Fund Administrators (“SBS”) modifies the Regulation for the authorization of companies and representatives of the Financial and Insurance System, approved by SBS Resolution No. 488-2026.
Through SBS Resolution No. 488-2026, published in the official newspaper El Peruano on February 19, 2026, the SBS modified the aforementioned regulation in the following aspects:
- The requirement to present a formal certificate of no objection from the foreign supervisor is eliminated when the prospective shareholders or ultimate beneficial owners of the company (for which organization authorization has been requested from the SBS) are controlling entities belonging to foreign financial or insurance systems. Instead, the SBS may directly gather information from foreign supervisors when it deems necessary.
- The suspension of the timeframe for granting the organization authorization while waiting for information from the foreign supervisor is suppressed.
- The timing is specified for when the SBS will communicate with the Central Reserve Bank of Peru regarding the submitted organization request—so that it may issue its opinion within a maximum period of 30 days—which will be once the comprehensive evaluation of said request is concluded, without requiring a response from the organizers' home supervisor.
