DRAFT PROCEDURE FOR THE QUALIFICATION OF ESSENTIAL LOADS IN THE NATIONAL INTERCONNECTED ELECTRICAL SYSTEM
The draft regulations for the Procedure for the qualification of essential loads in the National Interconnected Electrical System (“SEIN”), approved by Resolution No. 168-2025-OS/PRES of the Board of Directors of OSINERGMIN (“Procedure”), have been published for public comment.
On December 22, 2025, the Resolution approving the draft Procedure was published in the Official Gazette El Peruano to receive comments and suggestions from interested parties.
The relevant aspects are as follows:
- Objective and purpose: This Procedure seeks to establish criteria for classifying Essential Loads, in accordance with section 7.14 of the Technical Standard for the Coordination of Real-Time Operation of Interconnected Systems (“NTCOTRSI”), in an objective and transparent manner to safeguard the operational security of the National Interconnected Electric System (SEIN).
- Scope: The Procedure applies to (i) electricity supply companies (generators and distributors); (ii) distribution concessionaires whose circuits supply Essential Loads; (iii) users holding supplies that may qualify as Essential Loads; and (iv) the Economic Operation Committee of the System (“COES”).
- Qualification Procedure: This Procedure establishes guidelines to ensure the safe operation of the National Interconnected System (SEIN), including criteria for Essential Loads, their identification and proposal in accordance with the NTCOTRSI (National Technical Standard for the Regulation of the Interconnected System), the information requirements for requesting qualification, and the guidelines for evaluating such requests. For the purposes of qualification as an Essential Load, it is the responsibility of the supplying companies (generators and distributors) to submit the information specified in the Procedure. As part of the evaluation considerations, the following order of priority by sector is established for the qualification of Essential Loads:
The classification as an Essential Load is based on information requirements, established criteria, and considerations for preserving the security of the National Interconnected Electric System (SEIN). OSINERGMIN notifies both the requesting supplier and the account holder of the classification results.
- Deadlines: Applications for Essential Load classification must generally be submitted within the first 30 calendar days of each year, except for healthcare facilities or other relevant facilities as specified. Additionally, COES (the National Electricity Commission) annually prepares a study that determines and provides the technical support for the “Maximum Percentage of the Maximum Coincident Demand of feeders and other circuits with Essential Loads”. This study is submitted to OSINERGMIN by September 30th of each year, and its value is valid for all distribution companies.
- Non-compliance and penalties: The Procedure establishes a system of penalties for non-compliance directed at COES, suppliers, and distributors. Such non-compliance will be penalized according to OSINERGMIN’s current scale.
- Initial classification: The initial classification is as Essential Loads, for which suppliers and distributors must submit the information stipulated in the Procedure within 30 business days of its entry into force.
The Procedure has been pre-published on the OSINERGMIN website for public comment for a period of 30 calendar days, beginning December 23, 2025.
