LABOR NEWS

Mass registration of workers in the virtual system of the Mandatory Life Insurance Contract Registry is now enabled. The Ministry of Labor and Employment Promotion (MTPE) has announced that, as of August 8, 2025, it is possible to proceed in this manner. Previously, employers had to register individually.

In this regard, it is important to remember the following:

  • All workers subject to the private sector labor regime are entitled to Statutory Life Insurance from the start of their employment relationship.
  • The employer is required to register the information on the Statutory Life Insurance contract on the MTPE website within 30 calendar days of signing the contract.
  • Failure to comply with the aforementioned registration qualifies as a serious violation under the Regulations of the General Labor Inspection Law (RLGIT) for each affected worker.

MIGRATION NEWS

A new regulatory framework has been established for obtaining Peruvian nationality. The main changes in Law No. 32421, published on August 15, 2025, are as follows:

  • Five types of nationality by choice are recognized: naturalization, option, dual nationality, meritorious distinction, and qualified athlete.
  • The requirement for residence in Peru to apply for citizenship by naturalization is increased from 2 to 5 years.
  • The number of years of marriage to a Peruvian citizen to apply for citizenship by option is increased from 2 to 4 years.
  • Foreigners married to naturalized Peruvians may apply for Peruvian nationality by attaching the record of obtaining Peruvian nationality.
  • The deadlines for procedures to obtain Peruvian nationality have been extended to 18 months, extend.

The Law shall enter into force on the day following the publication of its regulations, for which a maximum period of 180 business days has been established from the publication of the Law.

INSPECTIONS

New precedents of mandatory compliance by the Labor Inspection Court (TFL). The following criteria of mandatory compliance have been established:

OCCUPATIONAL HEALTH AND SAFETY

The draft update to the directive on the investigation of workplace accidents and incidents has been published. The draft version 2 of the Directive on the conduct of investigative inspections in the event of workplace accidents and dangerous incidents, which guides labor inspectors in their oversight of this matter, has been published.

The proposal sets out certain amendments that would require an update from the latest version of the document issued in 2020.

Among the most relevant changes are the following:

  • It incorporates definitions of the “workplace” and the causes of accidents.
  • It identifies the criteria for defining the territorial jurisdiction of the investigation.
  • It specifies the investigation deadlines for fatal and non-fatal accidents.
  • It establishes the specific circumstances in which it will not be mandatory for the inspector to visit the accident site.
  • It outlines the criteria to be considered when gathering information and evidence about the accident.
  • It includes the possibility of issuing an inspection report in the event of a workplace accident.
  • It sets out the guidelines for reporting penalties imposed for fatal accidents to the Public Prosecutor's Office.

REMINDER OF THE MONTH

SUNAFIL letter requesting information on Supplementary Insurance for Hazardous Work (SCTR). - Among other documents, SUNAFIL is requesting employers to submit: (a) a list of workers registered on the electronic payroll from May 2025 to the date of submission, (b) TR5 and TR6 reports updated to the date of submission; and (c) a record of workers (proof of insurance) in the SCTR, including current copies of said record and proof of payment of the SCTR.
