Additional regulations issued by the State in response to the emergency situation in the natural gas supply

Within the framework of the declaration of emergency in the natural gas supply in the Production Systems, Hydrocarbons Transportation by Pipeline Systems, and Natural Gas Distribution by Pipeline Network Systems, established by Vice-Ministerial Resolution No. 004-2026-MINEM/VMH of March 1, 2026 (“RVM 004”), and the consequent activation of the natural gas rationing mechanism provided for in Supreme Decree No. 017-2018-EM, ordered through Directoral Resolution No. 020-2026-MINEM/DGH of March 1, 2026, the following additional measures have been approved:

1. Directoral Resolution No. 025-2026-MINEM/DGH, which establishes temporary exceptional measures regarding biofuel blends and their commercialization, in order to avoid an impact on the supply of Liquid Fuels in the national territory:

The resolution under discussion was published in the Official Gazette El Peruano on March 7 and provides an exemption from compliance with certain provisions of the Regulation for the Commercialization of Biofuels, approved by Supreme Decree No. 021-2007-EM, for agents that carry out blends of Fuel Ethanol with gasolines, as well as blends of Biodiesel B100 with Diesel 2 (the “Agents”).

This measure, which will remain in force for a period of fifteen (15) calendar days from its publication, is based on the Agents’ inability to comply with the provisions relating to the blending of Fuel Ethanol with gasolines and Biodiesel B100 with Diesel 2 due to logistical difficulties in accessing the inputs necessary to produce gasohols and B5 diesel. This situation prevents the commercialization of such products and, in the context of the emergency situation declared by RVM 004, could generate restrictions in the supply of Liquid Fuels, thereby affecting their availability.

2. Board of Directors Resolution of OSINERGMIN No. 040-2026-OS/CD, which approves exceptional and temporary measures to facilitate fuel supply during the natural gas supply emergency declared by RVM 004:

This regulation was published in the Official Gazette El Peruano on March 7 and approves various measures aimed at maintaining the availability of substitute fuels such as Liquid Fuels or Liquefied Petroleum Gas (“LPG”). The main measures include the following:

  • Allow the combined use of tractors and tankers registered under different records in OSINERGMIN’s Hydrocarbons Registry (“RHO”) by the same operator for the transportation of fuels.
  • Permit transport units authorized to carry gasoline and gasohols to also transport diesel in the compartments designated for those products.
  • Transport units with foreign license plates transporting hydrocarbon-derived fuels or LPG from import operations will not require registration in the RHO.
  • Exemption from RHO registration for certain agents in the LPG commercialization chain.

3. Emergency Decree No. 002-2026, which establishes extraordinary measures to promote access to LPG for vulnerable populations and mitigate the economic impact on beneficiaries of the GNV vehicle promotion program – AHORRO GNV – and natural gas vehicle users:

This regulation was published on March 8 and approves the exceptional, one-time delivery of a Discount Voucher financed by the Energy Social Inclusion Fund (“FISE”) in the additional amount of S/ 10.00, for active FISE Users under the Social Compensation and Promotion Program for Access to LPG, applicable exclusively to LPG cylinders of up to 10 kg.

Additionally, it was approved that FISE will finance, on a one-time and non-repayable basis, a benefit of S/ 120.00 (one hundred twenty and 00/100 Soles) for natural or legal persons providing special public transport services in the taxi modality using Compressed Natural Gas (CNG).

The Emergency Decree under discussion will remain in force until December 31, 2026.
