Remote gaming and sports betting: MINCETUR proposes new rules for operators and providers
On October 21, 2026, Ministerial Resolution No. 382-2026-MINCETUR was published, providing for the prepublication of the draft Supreme Decree amending the Regulations of Law No. 31557, the Law regulating the operation of remote gaming and remote sports betting. Interested parties may submit comments to MINCETUR until November 5, 2026. If approved, the regulation would enter into force on the day following its publication in the Official Gazette El Peruano.
The main proposed amendments are as follows:
- Lower fines: The maximum fines would be reduced from 50, 150, and 200 Tax Units (UIT) to 11, 35, and 70 UIT for minor, serious, and very serious infringements, respectively. In addition, the proposed amendments provide that a fine may not exceed 10% of the gross annual income for the year preceding the infringement.
- Greater fine reductions for acknowledgment of liability: If the offender acknowledges liability in writing before the final report of the investigative phase is issued, the fine would be reduced by 50%; if the acknowledgment is made thereafter, but before the sanction is notified, the reduction would be 35%. In both cases, payment must be made within 15 business days of notification. If the offender does not acknowledge liability but does not challenge the sanction and pays within the applicable deadline for filing an appeal, the reduction would be 25%. These reductions may not be combined and do not apply in cases of repeat offenses.
- Advertising: Advertising on unauthorized platforms and directing advertising toward minors are already prohibited, and a warning regarding gambling addiction is already required. The draft adds a requirement for each advertisement to identify the license holder and its authorization number; prohibits portraying betting as a source of income or associating it with social success; and requires the warning to remain visible for at least 5 seconds in audiovisual and digital media and to occupy at least 10% of a printed advertisement. It also regulates influencers and makes the license holder liable for advertising carried out by third parties.
- Providers of related services: At MINCETUR’s request, these providers would be required, within 10 business days, to disclose their brands worldwide and the companies with which they have entered into contracts, together with the services provided to those companies. Live casino providers would also be required to disclose the locations of their studios. Currently, registration is revoked if providers serve unauthorized platforms. Under the proposed amendments, registration would also be revoked for failure to provide the required information, the revocation would extend to all their products, and providers could not reapply for registration until one year has elapsed.
- Obligations of license holders: License holders would be required to submit their renewed guarantee to MINCETUR on the first business day of February, even if their operations are suspended, and to pay outstanding balances within 3 business days of a player’s request. Temporary suspension could not exceed 90 calendar days per year.
- Exchange rate: To convert into soles the financial information submitted to MINCETUR, the weighted average selling exchange rate published by the SBS on the closing date of operations would be used, instead of the rate applicable on the preceding day. This amendment seeks to align the conversion of reported information with the rules applicable to determining the tax base.
- Cryptocurrencies: Transactions involving cryptocurrencies would continue to constitute a serious infringement, but the applicable fine would range from 1 to 35 UIT, compared with the current range of 50 to 150 UIT.
- Prizes and bonuses: Amendments are proposed regarding prizes and bonuses that may have tax implications, although they are primarily framed as reporting and oversight requirements rather than as an express amendment to the tax base. The proposal also provides that establishing conditions allowing funds received as prizes or bonuses to be used for further bets that are excluded from the tax base would constitute a very serious infringement.
- Other amendments: The deadlines applicable to audits would be adjusted; access and reporting requirements would be addressed upon MINCETUR’s request; and provisions would be introduced governing the confiscation of goods, precautionary measures, and the remediation of infringements.
