Publication for Public Comments of the Draft Supreme Decree Approving the Regulatory Provisions Governing Energy Planning (the “Draft Regulation”)
On July 9, 2026, Ministerial Resolution No. 270-2026-MINEM/DM was published in the Official Gazette El Peruano, providing for the publication of the Draft Regulation for public comments.
The Draft Regulation aims to guide the development of Peru’s energy sector based on the principle of energy security by establishing the conditions, timelines, and stages applicable to energy planning.
Interested parties may submit comments, suggestions, and opinions to the Ministry of Energy and Mines (MINEM) until Wednesday, July 30, 2026.
The main aspects of the Draft Regulation are as follows:
- Scope: The regulatory provisions will apply to any individual or legal entity engaged in activities related to the energy sector.
- MINEM: Through the General Directorate of Energy Efficiency (“DGEE”), the Ministry of Energy and Mines is responsible for energy planning and is empowered, among other functions, to: (i) prepare energy planning plans, balances, reports, and related documents; (ii) support the monitoring of projects resulting from the energy planning process; and (iii) implement measures to ensure energy supply, protect consumers, promote competition, and reduce energy poverty.
- Energy plans: The National Long-Term Integrated Energy Plan (“PEIN”) and the specific energy plans are prepared every four years by the DGEE. The PEIN has a 30-year planning horizon and includes long-term energy scenarios and outlooks intended to provide technical and economic information to guide the development of the energy sector. Specific energy plans are short- and medium-term planning instruments that identify projects contributing to the sector’s development in line with the PEIN’s objectives.
- National Energy Balance: A technical and statistical instrument showing how energy is produced, transformed, traded, and consumed in the country. It serves as an input for energy planning and is prepared annually.
- Useful Energy Balance: A technical instrument used to assess how energy is consumed at the final-use level, based on information regarding equipment, frequency of use, operating hours, and efficiency. It serves as an input for energy planning and is prepared every six years.
- Information requirements: MINEM may request from energy sector participants any information necessary for energy planning. Such participants must provide the requested information within sixty (60) calendar days.
- Draft documents: Draft versions of the PEIN and the specific energy plans will be published for public comments.
- National Integrated Energy Planning Digital Platform (“PDPEN”): MINEM will create and use the PDPEN as a support tool for the collection, processing, and updating of energy-related information. Individuals and legal entities engaged in activities related to the energy sector and involved in the energy planning process must comply with the requirements of the platform in accordance with the procedure to be approved by MINEM.
- Final Supplementary Provisions: MINEM must implement the PDPEN and approve the procedure for energy planning under the Regulation within 180 and 90 calendar days, respectively, from the publication of the Supreme Decree.
