SUPREME DECREE NO. 014-2025-MTC
The Ministry of Transport and Communications (MTC) amends Article No. 36 and Section No. 43.1 of the Regulations for the Reception and Dispatch of Ships in the Ports of the Republic of Peru, approved by Supreme Decree No. 013-2011-MTC (hereinafter, DS 013)
MAIN AMENDMENTS
- Article No. 36 of DS 013 regarding the Reception and Dispatch of Vessels in rivers and lakes is amended, and henceforth deals with the general obligations of vessels in rivers and lakes. The article stipulates that, in river and lake areas, all vessels are required to comply with the reception and dispatch procedures established by the National Port Authority (APN), as well as to pay the corresponding fees in accordance with the Consolidated Text of Administrative Procedures (TUPA). However, it is established that nationally flagged vessels authorized to operate in coastal traffic by the Water Transport Authorization Directorate or the Regional Water Transport Directorate of the Regional Government (or the organizational unit acting on its behalf), whose gross tonnage is less than 500 GT, are exempt from the payment of such fees in the procedures for the Granting of Ship Reception and Granting of Ship Dispatch, provided that they have the respective authorization issued by the Directorate of Water Transport Authorizations or its regional equivalent.
- Article No. 43.1 of DS 013 regarding the submission of documents for vessels engaged in domestic or coastal water transport is amended, simplifying the procedure for submitting documents for vessels engaged in domestic or coastal water transport. Previously, the article required vessels flying the national or foreign flag to announce their arrival and/or departure using the Single Port Call Document (DUE), within specific time limits detailed in other articles of the regulation, and to submit the documentation set out in Annex 14. In accordance with the amendment introduced, the reference to those articles and Annex 14 is eliminated, establishing more generally that ships must announce their arrival and/or departure using the DUE within the legal deadlines, using electronic means regulated by the APN.
- Annex 14 of the Regulations for the Reception and Dispatch of Ships in the Ports of the Republic of Peru is repealed.
