AMENDMENTS TO THE CONSOLIDATED TEXT OF THE GENERAL REGULATIONS ON PUBLIC REGISTRIES
On July 1, 2025, Resolution No. 00090-2025-SUNARP/SN of the National Superintendency of Public Registries was published in the Official Gazette El Peruano, amending various articles of the Consolidated Text of the General Regulations of Public Registries, approved by Resolution No. 126-2012-SUNARP-SN. The main amendments are detailed below:
- The strikeout for expiration of the filing entry as a means of concluding the procedure has been eliminated, replacing it with the sole configuration of expiration.
- Incorporating the regulation of the Digital Intermediation System (SID-SUNARP), it is clarified that the title may be recorded in electronic form. In this regard, it is specified that withdrawal may also be requested electronically.
- It is clarified that, although the SID-SUNARP is available 24 hours a day, every day of the year, the entry in the registry office's journal is generated in strict order of receipt during the journal's office hours.
- It is clarified that public documents with digital signatures may be submitted in printed form if they contain a verification mechanism, such as a Digital Verification Code.
- It is indicated that copies authenticated by an institutional notary of the corresponding Registry Office, in electronic format, of the documents that make up the title in paper format, have legal value.
- It is established that, in titles issued by physical court rulings, when the applicant has indicated that they are acting in the interest of another person, the withdrawal may also be requested by an authorized representative of that person.
- The settlement of registration fees made within the last five days of the validity of the filing entry generates an automatic extension for an additional ten days, of which five are for making the payment and five are for extending the entry. Likewise, payment of the higher fee is accepted until the last day of the validity of the filing entry, in which case the validity is automatically extended for an additional five days.
- In the definition of qualification, it has been indicated that the Registrar and the Registry Court must ensure proper compliance with specific registry principles and higher principles that protect the rights of those administered, with special attention to the principle of predictability and other principles of general administrative procedure that are compatible.
- Observations and objections must be drafted in plain language, with legal basis and, if possible, indicating how to correct the errors. Mere references to rules, general statements, or vague information that do not clarify the registry decision are not accepted as grounds for objection.
- The clarification or modification of the registrable act or right made after the filing entry for the purpose of correcting an observation shall not be grounds for substantive challenge.
The amendments will enter into force on August 1, 2025.
