Regulation Implementing the Legislative Decree Promoting 5G Deployment Is Amended, and Publication of the Draft Interconnection Rule Is Approved

On October 14, 2026, the following rules were published in the Official Gazette El Peruano:

  1. Supreme Decree No. 019-2026-MTC (“Supreme Decree 019”), which amended the Regulation of Legislative Decree No. 1627 (the “Regulation”). The latter governs the special spectrum allocation mechanism for 5G or higher technology.
  2. Board of Directors Resolution No. 000132-2026-CD/OSIPTEL (“Resolution 132”), which publishes the Draft Interconnection Rule for comment.

The Supreme Decree 019 amended the Regulation to allow companies to use the spectrum allocation they obtain under the regulated allocation mechanism to fulfill obligations or commitments assumed with the State in connection with the provision of public telecommunications services. In addition, it incorporated Article 19-A, allowing the General Directorate of Communications Programs and Projects (DGPPC, by its Spanish acronym) to evaluate, approve, and execute, on behalf of the MTC, addenda to the single concession contracts entered into under the special allocation mechanism.

Resolution 132, for its part, publishes a proposed replacement text for the Consolidated Text of the Interconnection Rules, approved by Board of Directors Resolution No. 134-2012-CD/OSIPTEL (the “Draft”).

If approved, the Draft would entail (i) an update of the technical rules applicable to interconnection in order to incorporate networks based on the Internet Protocol (IP) and other technologies; (ii) the approval of a Reference Interconnection Offer (ORI, by its Spanish acronym), to which operators may voluntarily adhere; (iii) the creation of an Interconnection Support Panel, which may be convened by OSIPTEL to facilitate the handling of technical matters and the pursuit of agreements during the negotiation, evaluation, or performance of interconnection relationships; and (iv) the updating of the procedures for the negotiation, approval, and amendment of interconnection contracts and mandates, among others.

Interested parties may submit comments on the Draft within thirty (30) calendar days from the day following the publication of Resolution 132, a period that expires on Friday, November 13.
