Regulation for the Granting of Authorizations for the Discharge and Reuse of Treated Wastewater amended

On August 9, 2026, Resolution No. 194-2026-ANA was published in the Official Gazette El Peruano, amending the Regulation for the Granting of Authorizations for the Discharge and Reuse of Treated Wastewater, approved by Resolution No. 224-2013-ANA. The amendments are as follows:

  • The holder of the activity generating the treated wastewater to be discharged is not required to hold a water use right in the following cases: (i) planned discharges, in which case it is sufficient to have an approved Environmental Management Instrument (IGA); (ii) discharges from mine water or precipitation, provided that such water has not been used in the main activity or production process; and (iii) other activities that are not required to hold a water use right.
  • Discharge and reuse authorizations may be modified due to changes in technical characteristics. For this purpose, the corresponding IGA must be submitted.
  • Renewal procedures for such authorizations are subject to automatic approval.
  • The following documents are no longer required as annexes to applications for discharge authorizations: (i) the favorable technical opinion issued by DIGESA; (ii) a descriptive report of the industrial process; and (iii) the operation and maintenance manual for the wastewater treatment system.
  • In emergency situations resulting from extreme weather events, the holder of a discharge authorization may carry out extraordinary discharges, which must be reported to the environmental enforcement authority and the National Water Authority within 24 hours of the event. The holder must demonstrate the force majeure or fortuitous event preventing compliance with the authorization conditions, as well as the temporary nature of such circumstances.

Procedures pending at the time the regulation enters into force shall be adapted to the approved amendments without reverting to previous stages or suspending deadlines.
