Temporary suspension of the sale and use of certain pesticides identified by the Constitutional Court
Through Directorial Resolution No. D000015-2026-MIDAGRI-SENASA-DIAIA, published on September 30, 2026 in the Official Gazette El Peruano, SENASA ordered the implementation of Judgment No. 1111/2026 issued by the Second Chamber of the Constitutional Court.
The measure temporarily suspends the sale, distribution, and use of agricultural pesticides containing chlorpyrifos, methomyl, glyphosate, imidacloprid, and clothianidin. The restriction applies to products containing such active substances that are intended for the production of plant-based food for domestic consumption.
The suspension is precautionary, temporary, and subject to review. It will remain in effect until the following two conditions are met:
- The technical-scientific reassessment of the aforementioned substances is completed.
- Sufficient control, traceability, and sanitary response mechanisms are implemented.
Both conditions must be met concurrently, and the competent judicial authority will determine whether the measure is to continue, be modified, or be lifted.
This measure does not suspend or cancel the registrations of the products concerned. In addition, SENASA will publish and keep updated an official list of pesticides with current registrations that contain the aforementioned active substances.
Furthermore, SENASA's Executive Directorates will intensify surveillance, oversight, and control actions, including with respect to storage.
The Resolution provides that authorized establishments be notified of their obligation to refrain from carrying out the activities covered by the measure in respect of these products, when intended for the production of plant-based food for domestic consumption, for as long as the measure ordered by the Constitutional Court remains in effect. SENASA may apply the applicable sanitary or administrative measures and coordinate oversight actions with the Public Prosecutor's Office and other competent authorities.
