Draft Amendments to the National Building Regulations and the Social Housing (VIS) Regulation Published

On July 16 and 19, 2026, draft regulations proposing amendments to Standard A.130 of the National Building Regulations (RNE) and to the Regulations of the Social Housing Law (VIS), respectively, were published.

The main amendments proposed to the VIS Regulation include:

  • The minimum built-up area for housing units in multifamily residential projects will be 40 m², while single-family homes must have a minimum built-up area of 35 m².
  • For five (5) years following registration of the transfer with the Public Registry, beneficiaries may not transfer ownership of the property, lease it, and must use it as their primary residence.
  • As a general rule, one parking space for motor vehicles will be required for every three housing units. For projects located near mass transit systems, the requirement will be reduced to one parking space for every five housing units.
  • Applications submitted to municipalities for urban development permits or building permits must expressly indicate that the project qualifies as a Social Housing (VIS) project.
  • The Ministry of Housing may conduct inspections and adopt administrative measures in cases of non-compliance with VIS regulations. Violations may be sanctioned with warnings or fines, depending on their severity and the number of affected housing units. The Ministry may also notify the relevant municipality of any non-compliance so that it may take the corresponding actions within the scope of its authority regarding the issued permit.

It is worth noting that Metropolitan Ordinance No. 2361-MML remains in force in the Province of Lima, while Provincial Ordinance No. 007-2025/MPC continues to apply in the Constitutional Province of Callao. Both regulations provide significant urban planning incentives for Social Housing (VIS) projects, particularly in relation to maximum building heights and density limits.

Regarding the proposed amendments to RNE Standard A.130, the initiative seeks to consolidate all building safety provisions into a single regulation, with a particular focus on fire safety.

The new standard will apply exclusively to new buildings, except where an existing building undergoes a change of use, renovation, or expansion.

In such cases, compliance may be achieved—subject to technical feasibility and structural or architectural limitations—through any of the following alternatives:

  • Compliance with the new standard.
  • Full compliance with the provisions applicable to existing buildings under NFPA 101.
  • Implementation of a fire protection strategy based on risk assessment, fire load, and fire spread analysis, subject to approval by the competent authority.

Comments, suggestions, and opinions on the draft VIS Regulation may be submitted until August 4, 2026. Comments on the proposed amendments to RNE Standard A.130 may be submitted until September 3, 2026.
