New Consolidated Text of Law No. 27444 – General Administrative Procedure Law
On April 30, 2026, Supreme Decree No. 006-2026-JUS was published in the Official Gazette El Peruano, approving the new Consolidated Text (Texto Único Ordenado) of Law No. 27444, the General Administrative Procedure Law (the “new Consolidated Text”).
The issuance of the new Consolidated Text responds to the need to compile, organize, and systematize the various regulatory amendments made to Law No. 27444 following the approval and entry into force—now repealed—of Supreme Decree No. 004-2019-JUS, which approved the previous consolidated text at the end of January 2019 (the “previous Consolidated Text”).
Its purpose is to preserve the systematic coherence of the law, which may have been affected by subsequent amendments, incorporations, and repeals, and to ensure that both public administration entities and individuals have access to a single, consolidated legal text that facilitates consultation and application.
This is the third regulatory instrument issued with the aim of organizing and consolidating Law No. 27444, a role previously carried out by Supreme Decree No. 006-2017-JUS, published on March 20, 2017, and the aforementioned Supreme Decree No. 004-2019-JUS, published on January 25, 2019.
Since the approval of the previous Consolidated Text in 2019, Law No. 27444 has undergone several relevant amendments, primarily aimed at the digitalization of administrative procedures, the standardization of administrative processes, the rationalization of administrative fees, and enhanced efficiency in the resolution of administrative appeals. The new Consolidated Text organizes and systematizes these changes, incorporating in a structured manner the amendments introduced, among others, by the following regulations:
- Legislative Decree No. 1497: introduces and regulates standardized administrative procedures and exclusive services, strengthening the leadership role of the Presidency of the Council of Ministers (PCM) and limiting administrative discretion in setting requirements, deadlines, and fees.
- Law No. 31465: strengthens digital document management by establishing mandatory digital filing systems available 24/7, recognizing email or electronic mailbox addresses as essential information of the applicant, and affirming the functional equivalence between physical and digital documentation.
- Law No. 31603: amends the administrative appeals regime by reducing, as a general rule, the deadline to resolve motions for reconsideration to fifteen (15) business days, in line with procedural efficiency objectives.
- Legislative Decree No. 1561: deepens the administrative simplification and standardization system, detailing rules on the Single Administrative Procedures Text (TUPA), procedural transparency, and the ratification process for administrative fees, with joint intervention by the PCM and the Ministry of Economy and Finance.
- Law No. 31724: introduces differentiated treatment regarding administrative fees for micro and small enterprises (MYPEs), mandating fee reductions and the immediate adjustment of sectoral TUPAs.
- Legislative Decree No. 1633: establishes a special regime for regulatory agencies, extending the deadline to resolve motions for reconsideration to thirty (30) business days when their boards act as the sole administrative instance.
While the new Consolidated Text does not have innovative or interpretative effects—and therefore does not alter the legal force of Law No. 27444—it is noteworthy that, unlike its predecessors, it restores the original structure of the law and adopts an alphanumeric numbering technique. This approach allows the insertion of intermediate provisions without altering the existing numbering (e.g., Articles 41 and 41-A, instead of Articles 41 and 42). As a result, the first twenty-nine (29) articles retain their original numbering, while the remaining two hundred thirty-eight (238) articles have been renumbered.
