PUBLICATION OF BILLS FOR THE PROTECTION OF CHILDREN AND ADOLESCENTS IN DIGITAL ENVIRONMENTS

Bills No. 10880/2024-CR and No. 13453/2025-CR (“Bills”) are currently being debated in the Congress of the Republic. Their purpose is to strengthen the protection of children and adolescents in the use of digital environments and online services.

The Bills have been subject to legislative analysis through various reports, which have included comments, observations, and modifications to the original proposals. These reports have been issued within the framework of the work of the following parliamentary committees:

  • Health and Population Committee;
  • Women and Family Committee; and
  • Education, Youth and Sports Committee.

For the public telecommunications services sector, one of the most relevant aspects is the imposition of specific obligations on the operating companies that provide these services. Among the proposed measures, the following stand out:

1. The obligation to provide users with parental control tools or mechanisms that allow them to:

  • Activate profiles for a child or adolescent;
  • Set time limits and usage limits;
  • Apply content filters by category; and
  • Activate default protection settings.

2. Install systems or tools for educational purposes and to promote the well-being and mental health of minors.

3. Reporting obligations related to the Registry of Mobile Devices Used by Children and Adolescents (RDU-NA), the availability, activation, and deactivation of parental controls or content filters, as well as obligations to display preventive messages about risks to the mental health and digital well-being of children and adolescents at points of sale and in advertising materials.

The Bills also establish obligations for digital service providers, stipulating that the corresponding regulations will develop technical standards, risk proportionality, and accessibility criteria so that these providers treat all users under eighteen (18) years of age as subjects of enhanced protection.

Regarding these projects, it is important to remember that, since 2022, Article 7 of Law No. 30254, the Law for the Promotion of the Safe and Responsible Use of Information and Communication Technologies by Children and Adolescents, establishes obligations for internet service providers to inform users—before contracting and every six (6) months thereafter—about the option of implementing blocking filters on home or mobile devices to block pornographic or other violent content, in order to protect children and adolescents.
