OSIPTEL Amends the Regulation on Claims by Users of Public Telecommunications Services
On October 3, 2026, Board of Directors Resolution No. 000129-2026-CD/OSIPTEL was published in the Official Gazette El Peruano, amending the Single Consolidated Text of the Regulations on the Handling of Requests and Complaints Filed by Users of Public Telecommunications Services (the “Complaints Regulations”).
The amendments to the Complaints Regulations include, among others:
- An adjustment to the applicable deadlines. For example: (i) a maximum period of ten (10) business days for operating companies to resolve complaints; (ii) five (5) business days to conduct operational tests, technical visits, and other proceedings in complaints concerning quality and suitability; and (iii) ten (10) business days (extendable) for TRASU to resolve appeals or complaints. The deadlines for filing complaints or other claims are also adjusted.
- To allow operating companies, at their discretion and upon prior notice to OSIPTEL, to implement an Intelligent Digital Form with automated functionalities.
- To repeal the Service Set as an alternative for companies with 500,000 or fewer subscribers, which will be required to use the Interoperable System or the physical medium.
- To require operators to address issues recorded within a maximum period of three (3) business days, unless the Technical Instruction establishes a different period.
Finally, the regulation repeals, effective November 1, 2026, the mechanism that allowed OSIPTEL to order the unblocking of mobile terminal devices not registered on the “White List.” Going forward, the regularization of such devices will be carried out exclusively through the ordinary registration mechanisms.
The Regulation will enter into force ten (10) months after its publication. However, certain provisions will take effect as of October 4, 2026, including, among others, those relating to the Interoperable System.
